Apprehending arrest in connection with Crime No.392/2010 registered at Police Station- Sakti, District - Janjgir-Champa (C.G.), for offence punishable under Section 166, 167, 420, 468, 471, 120B, 34 of Indian Penal Code, the applicant has preferred this application for grant of anticipatory bail.

As per the prosecution case, a complaint was filed by one Shyam Sunder Agrawal and FIR was registered, wherein it is alleged that the applicant in connivance with the revenue officer has committed fraud in respect of the land bearing Kh.No.815/47 admeasuring 0.23 acres and KH.No.31/2 admeasuring 0.22 acres. 3.

The State counsel at the very outset submits that as per the memo received on 30.09.2016, wherein it is stated that till date no offence is said to have been found to be committed by the present applicant and still the investigation is going on.

Perused the memo dated 30.09.2016, which is of Police Station Sakti, District -Jangir-Champa, which shows that no case is registered against the present applicant. Therefore, it will be futile to go on the merits of this case at this stage. Further the liberty is granted to the applicant to move suitable application, as and when occasion arises.
