Mr. Anil S. Pandey, Govt. Advocate --------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Goutam Bhaduri Order On Board 07.10.2016 1.
This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.24/2016 registered at Police Station- Udaypur, District Sarguja (C.G.) for the offence punishable under Section 363, 370/34, 87, 81, 11 of Indian Penal Code, Section 14 of Child Labour Prohibition & Regulation Act, 1986 and Section 3(1)(R) of Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act. Learned counsel for the applicant would submit that the charges have not been framed, therefore, the bail application may be considered.
3.
Considering the earlier bail rejection order dated 21.07.2016 passed in M.Cr.C. No.3840 of 2016, I do not find any change of circumstances, as reasonable time also is to be provided for a case; therefore, I am not inclined to entertain the instant second bail application.
4.
Accordingly, the second bail application filed under Section 439 of Cr.P.C. is dismissed.
