Hon'ble Shri Justice Goutam Bhaduri Order on Board 07.11.2016

1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 303/2016 registered at P.S. Chakradharnagar Distt. Raigarh (C.G) for the offence punishable under Sections 356, 379 of IPC.

2. As per the prosecution case, on 22.09.2016 at about 6 p.m., the applicant snatched a gold chain from the neck of the complainant Kaushalya Bai whereby the offence is committed.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and he has not committed any offence and hence the complainant and applicant have entered into compromise which would be evident from Annexure A-2. He, therefore, prays for releasing the applicant on bail.

4. Per contra, learned State Counsel opposes the bail. Earlier

learned State Counsel was directed to verify the affidavit of the complainant, upon which, it is reported that the complainant has entered into compromise with the applicant and no grievance stands remained against the present applicant.

5. Considering such facts and circumstances of the case, without any further observation on merits of the case, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He shall also appear before the trial Court as and when directed by the said Court.
