The present Contempt Petition has been filed alleging noncompliance of the Order dated 14.03.2018 passed in WPS No. 2090 of 2018.

The direction of this Court was for the Respondent No. 4 and 5 to consider and decide the objection raised by the applicant/petitioner. The Respondents now have entered their appearance and have produced a document dated 08.05.2019 intimating the Court that the Order has since been complied with and the objection of the applicant/petitioner has been considered and decided. The applicant though raises objection that the compliance being too belated and further the decision of the respondents also not being as per recommendations made by the Commissioner is contrary to the Rules and policy of the
Government.

This Court at this juncture, is of the view that though the compliance is belated but now the department has decided the objection of the petitioner/applicant. The order/direction given by this Court thus stands complied with.

The remedy now left for the petitioner/applicant would be to challenge the subsequent decision, as the veracity and merits of said order cannot be decided under the contempt jurisdiction of this Court. Reserving the right of the petitioner to challenge the subsequent decision. The present Contempt Petition in its present form at this stage stands disposed.
