The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.423/2017 registered in Police Station Durg, District Durg (C.G.) for offence punishable under sections 406, 420 of IPC.

Case of the prosecution, in brief, is that the applicant had published forged advertisement for appointment in merchant navy and thereafter when the candidates contacted on the different dates amount was deposited to the extent of 2.60 lakhs, however job was not given as such report was made. Thereby offence is committed. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, there is no evidence on record to inculpate the applicant, therefore the applicant may be released on bail. 4.

Perused the statement of the complainant Lokendra Mandavi. Considering the statement, this court is not inclined to grant regular bail to the applicant and it is dismissed.

However, prayer has been made during the course of argument that

the applicant may be released on temporary bail as marriage of his sister is fixed on 3/12/2017.

Learned State counsel was directed to verify the same. State counsel after verification affirmed the fact that marriage of the sister is fixed on 3/12/2017.

Considering the same, I am inclined to release the applicant on temporary bail for a period of 15 days from the date of his release. It is directed the applicant shall be released on temporary bail for a period of 15 days from the date of his release on his executing a personal bond for a sum Rs.25,000/- with one surety for the like sum to the satisfaction of the trial Court. He shall surrender before the trial court immediately after completion of 15 days.
