The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail in connection with Crime No. 82/2019 registered at Police Station : Directorate of Revenue Intelligence through the Intelligence OfÏcer, Nagpur Regional Unit for the offence punishable under Sections 20, 28, 29 & 30 of N.D.P.S. Act. 2.

As per the prosecution case, on the basis of secret information, ofÏcers of directorate of revenue intelligence apprehended the truck bearing registration No. BR-03 K-3093 and seized 276 Kg. contraband cannabis (Ganja) from the possession of truck driver. During interrogation, truck driver stated that he was transporting cannabis (Ganja) on

instruction of present applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime in question. He further submits that there is no direct evidence against the applicant and no cannabis was seized from the conscious possession of applicant. He also submits that the applicant is in jail since 06.05.2019, therefore, he may be released on bail.

On the other hand, State counsel opposes the bail application and submits that the quantity of seized cannabis (Ganja) is very huge.

I have heard learned counsel for the parties and perused the record.

Considering the totality of the facts and circumstances of the case, in particular the quantity of seized cannabis (Ganja), at this stage, I am not inclined to release him on bail. 7.

Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is rejected.
