1. As per applicant, this is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no other bail application is pending before any other Court.

2. The applicant has been arrested in connection with Crime No.71/2021 registered in Excise Circle - Baloda, District Janjgirchampa (CG) for offence punishable under Sections 34 (1) (d), 34 (2) of C.G. Excise Act.

3. As per prosecution story on 22/10/2021, 20 bulk liter of hand made liquor has been seized from the illegal possession of applicant.

4. Counsel for the applicant submits that this is first crime registered against the present applicant, she is innocent and falsely implicated in this case, she is in jail since 22/10/2021, chargesheet has already been filed, trial will take more time, therefore,

she be released on bail.

5. Per contra, learned State counsel opposes the bail application. He submits that as per case diary there is no previous criminal antecedent against the present applicant.

6. I have heard learned counsel for both the parties.

7. Considering the facts and circumstances of the case no previous criminal antecedent against the applicant, offence is triable by Judicial Magistrate First Class, applicant is in jail since 22/10/2021, I feel inclined to allow the bail application. It is directed that if the applicant furnishes one solvent surety for a sum of Rs.25,000/- along with one personal bond in the like sum to the satisfaction of the trial Court concerned for her appearance before the concerned Court as and when directed by the said Court, she be released on bail.
