Additional Director, Directorate of Higher Education Department, Atal Nagar, Raipur (CG) 3.

Principal, Government Narayanarao Maghavale Girls College, District Dhamtari (CG) ... Respondents For Petitioner :

For Respondents :

Ms. Sunita Jain, Govt. Advocate.

Hon'ble Shri Justice P. Sam Koshy Order on Board 22/10/2019 1.

The present application has been filed seeking modification of the order dated 16.5.2019 passed in WPS No. 3801/2019.

2.

The modification sought for is to the extent that in the cause title of the said writ petition the subject of the petitioner had been inadvertently mentioned as "Physics" instead of "English". The said error had arisen on account of an error on the part of the office of the counsel for the petitioner who had drafted the writ petition.

3.

Of late, this Court has been witnessing a large number of such kind of applications from the office of the counsel for the petitioner and every application is being filed only for the change of the subject so far as the petitioners are concerned. In spite of repeated caution being given by this Court, it appears that the office of the counsel for the petitioner is not taking necessary precautions in avoiding such silly mistakes and this Court is burdened with MCC after MCC on daily basis, particularly from the office of the counsel for the petitioner.

4.

Reluctantly though, this Court is forced to impose on the petitioner, for filing of unnecessary avoidable MCCs, an amount of Rs. 1500/- as cost, to be paid within a period of 7 days from today.

5.

Subject to the depositing of the said cost within the stipulated period, the MCC would stand allowed and the subject of the petitioner in WPS No. 3801/2019 and in the order dated 16.5.2019 shall be read as "English" instead of "Physics".

6.

Let this order be read as a part of the order dated 16.5.2019 passed in WPS No. 3801/2019 and also be made a part of the record of the said writ petition.

7.

With the aforesaid observations, the MCC stands disposed of. Sd/- (P. Sam Koshy) /sharad/ JUDGE
