1. Petitioner has preferred this writ petition under Section 482 Cr.P.C. against the order dated 03.10.2016, passed by the Sessions Judge, Bemetara, dismissing his application under Section 389 Cr.P.C. for suspension of sentence awarded by the trial Court upon his conviction for committing offence under Section 34 (2) of the Chhattisgarh Excise Act, 1915.

2. Having heard learned counsel for the parties, ends of justice would be served if the petition is disposed of with a direction to the Sessions Judge, Bemetara to hear and decide the pending appeal preferred by the petitioner at the earliest, preferably within a period of 15 days from the date of production of certified copy of this order before the sessions Court.
