It is argued that the petitioners' appeal before the DRT against the proceedings drawn by the District Magistrate under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and the auction proceedings are pending consideration before the DRT, Jabalpur, however, the Bench is not available from 24.9.2018 to 29.9.2018 and the auction is fixed for today, therefore, the petitioners have rushed to this Court only for interim relief for a period up to when the Bench of DRT would be available.

Considering the entire facts situation of the case, the writ petition is disposed of with direction that for a period up to 3rd of October 2018, the auction proceedings shall remain stayed and if the auction has already taken place, the same shall not be finalised.

This order shall lose its efficacy immediately after 3rd of October 2018. The petitioners would be at liberty to press their application for interim relief before the DRT, Jabalpur immediately when the Bench is available.
