The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.73/2016 registered in Police Station Nagri, District Dhamtari (CG) for offence punishable under section 44/09 of Wild Life (Protection) Act, 1972.

As per the prosecution case, on 20/09/2016 while the applicant alongwith others were travelling in a jeep, two live tortoise were found in his possession.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, he was only passenger of the jeep, seizure was made from Motilal, charge sheet has been filed, no further investigation would be necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, nature of allegation and the evidence available, charge sheet has been filed and the applicant is in jail since 20/09/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
