This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.129/2016 registered at Police Station- Telibandha, District Raipur (C.G.) for the offence punishable under Section 327/34 of Indian Penal Code. The earlier bail application was dismissed on merit on 24.08.2016 in MCRC No. 4916 of 2016.

Learned counsel for the applicant would submit that the charge sheet has been filed in this case, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perusal of the earlier bail rejection order would show that no liberty was given to the applicant and the bail application was dismissed on merit, therefore, under the facts and circumstances of the case, I do not find any change of circumstances to reconsider the instant second bail application.

Accordingly, the bail application is dismissed at the admission stage itself.
