This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.225/2016 registered at Police Station- Utai, District Durg (C.G.) for the offence punishable under Section 420 of Indian Penal Code. 2.

As per the prosecution case, on 22.08.2016 in order to provide job in the police department, the applicant has received an amount of Rs.16 Lakhs from Poshan Lal, Rajeev Patel, Kushal Ram, Ramavtar Sahu and Vinod Patel; thereby forgery has been committed.

Learned counsel for the applicant would submit that there is no evidence available against the present applicant and there has been some monetary transaction was existing in between the complainant Poshan Lal and the present applicant and in order to create pressure, the false allegations have been made; therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Further perused the statement of Jagesh Kumar Sahu, Chandra Kumar Sahu, Rajeev Patel, Rameshwar Patel, Kushal Ram and Ramavatar Sahu who have alleged that they have paid the amount to the present applicant. Considering such statements, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
