The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.97/2016 registered in Police Station Gariyaband, District Gariyaband (CG) for offence punishable under sections 363, 370, 374, 120 (B), 34 of Indian Penal Code. 2.

As per the prosecution case, the applicant alongwith one Amit and Ramesh had took away Pintu, Shekhar, Raj Kumar, Tularam from the lawful guardianship of their parents to Banglore to provide job, however after serving when money was demanded they were denied. Consequently, report was made.

Learned counsel for the applicant submits that as per the statement of Amit one of the co-accused it would reveal that Golu Sahni, Pintu etc. they were working as a labourer and affidavit has been furnished by Golu Sahni complainant that due to some misunderstanding report was made, therefore the applicant may be released on bail. 4.

Learned State counsel was directed to verify the fact about the affidavit. State counsel on verification submits that affidavit has been submitted by Golu Sahni, Durpat and Hemin Bai who are related to

Tularam, Jhunu Ram, Rajkumar, Shekhar, Kedar Sahni etc. who were working as a labour.

Taking into these facts, nature of allegation and also for the fact that charge sheet has been filed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
