1. The Challenge in the present writ petition is to the order (Annexure P-1) dated 22.08.2019 whereby the petitioner has been transfered from the office of Deputy Director Panchayat Jashpur to the office Deputy Director Panchayat, Korba.
2. Counsel for the petitioner submits that the petitioner vide order (Annexure P-4) dated 13.08.2019 was placed under suspension pending disciplinary proceedings and his headquarter were attached to the Janpad Panchayat Bagicha and in a short span of time, the impugned order has been passed transferring the petitioner to a place outside the district.
3. The contention of the petitioner is that transferring the petitioner, during the pendency of the disciplinary proceedings would have an adverse impact on the disciplinary proceedings and the petitioner also would find it difficult to conduct effectively the Departmental Enquiry initiated by the respondents.
4. Given the aforesaid facts, let the petitioner make all these grounds in the representation within a period of 10 days' from the date of receipt of copy of this order and respondents in turn shall consider the representation of the petitioner within further period 45 days'.
5. Till the representation is decided, there shall be a stay of the effect and operation of the order so far as the petitioner is concerned.
6. The writ petition stands disposed of.
