Instant petition has been filed for contempt of the order dated 30/07/2019 passed in WPS No.5576/2019 and the petitioner would submit that the petitioner though have been directed to join at the earlier place of posting, however he is not been allowed to do so and the CMO though have permitted the petitioner to join on the same post but it is being objected by the BMO. 2.

Subject of order dated 30/07/2019 was not with respect to the joining or not joining. It is only pursuant to the stay of transfer. If order dated 30/07/2019 has not been followed, then only contempt would be made out. At this juncture it cannot be said that prima facie contempt has been committed by the respondent.

Accordingly, the contempt petition is dismissed. The petitioner shall be at liberty to file appropriate petition as and when occasion arise. SD/- /Sd/- gouri Goutam Bhaduri Judge
