The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.114/2016 registered in Police Station Devri, District Balod (CG) for offence punishable under section 306 read with Section 34 of Indian Penal Code. 2.
As per the prosecution case, one Anjulata set herself ablaze on 20/05/2015. It is alleged that she was married to the son of the applicants who are father-in-law and mother-in-law of the deceased and she was subjected to harassment and the applicants have abetted the deceased to commit suicide. Thereby, offence has been committed. 3.
Learned counsel for the applicants submits that the applicants have been falsely implicated in the case and brother of the deceased has filed an affidavit in this court which would show that the deceased was suffering with sickle cell and that was cause of death. He further submits that the FIR was made on 28/03/2016, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents which also contains the dying declaration. Considering the nature of evidence and allegation against the applicants and also for the fact that charge sheet has been filed, this court is inclined to release the applicants on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
