Heard on I.A. No. 01/2017, application for condonation of delay in filing the appeal.

It appears that after acquittal by the JMFC, against acquittal appeal was preferred before Sessions Judge. Subsequently, when it was held that appeal was not maintainable, present Cr.M.P. is filed.

On due consideration, considering the reasons attributed for the delay, delay of 168 days in filing the Cr.M.P. is condoned.

Heard on application for grant of leave to appeal. On due consideration, leave to appeal is allowed. Registry is directed to register the case as acquittal appeal. List the case thereafter for hearing.
