It appears that after dismissal, the petitioner had prosecuted his relief before the wrong forum, which was dismissed by an order dated 13.07.2017. Thereafter, the instant CRMP has been filed whereby relief has been sought for to leave to appeal.
On due consideration and for the reasons stated in the application, the delay of 168 days in filing the petition is condoned. Also heard on application for leave to appeal. Considering the statement of the complainant, leave to appeal is allowed.
Registry is directed to register the case as Acquittal Appeal. Since the respondent has already represented, no further notice is required.
The respondent is directed to furnish a bail bond of Rs.25,000/- before the trial Court within a period of one month so that his presence may be procured in this appeal before this Court as and when needed. List for final hearing along-with ACQA No.9/2018. Sd/- Li (Goutam Bhaduri) Judge Ashok
