Learned counsel for the petitioner submits that the petitioner's land was acquired bearing Khasra No.1212/1, admeasuring 0.06 acre situated at Village Amartal, Tahsil Akaltara for construction of Canal; however, till date no compensation has been given and whether any acquisition has been made or not, it is also not made clear. The petitioner therefore prays that the representation which has been made to the Collector may be decided so as to know the whereabouts of the petitioner.

Considering the prayer made, it is directed that if the petitioner may make a fresh representation stating all the facts about their dispossession and the particulars of the land to the Land Acquisition Officer then in such case the same shall be decided. Meaning thereby, if the award has already been passed then the compensation should be released in favour of the petitioner

and if the award has not been passed and petitioner has been dispossessed without any acquisition then proceedings for compensation may be commenced. The petitioner shall have liberty to come back to the Court as and when the cause of action arises.
