1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 83/2018 registered at Police Station Rajpur, Distt. BalrampurRamanujganj (C.G) for the offences punishable under Section 489 (B)(C) of IPC.

2. As per the prosecution case, on receipt of information through informer the police conducted a raid and from the possession of the applicant, 7 fake currency notes of Rs.500/- denomination and one fake currency note of Rs.2000/- denomination, total amounting to Rs. 7500/- were recovered.

3. Learned counsel for the applicant submits that as per the memorandum statement, the said notes were given by his nephew and he had only kept those notes with him and had not used them for exchange of goods. He further submits that the charge sheet has been filed, no further investigation

is necessary and the applicant is in jail since 27.06.2018, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. Considering the facts and circumstances of the case especially looking to the total sum and number of such currency notes recovered from him as also the fact that the charge sheet has been filed and the applicant is stated to be in jail since 27.06.2018, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
