The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.142/2016 registered in Police Station Jarhagaon, Mungeli for offence punishable under sections 22 (b), 29 of NDPS Act.

As per the prosecution case, on an information received that the applicants alongwith others are selling contraband medicines with psychotropic substance, raid was conducted on 30/06/2016, the area was cordoned and the applicants alongwith other co-accused were apprehended and from their possession Nitrocin tablet 10x4, Alfrajolam 50 tablets, Magnet tablet 20 strips and Korex Cough Syrup 7 bottles were found. Thereby, offence has been committed.

Learned counsel for the applicants submits that the applicants have been falsely implicated in the case, no seizure has been made from the applicants, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the nature of allegations which shows that when the area was cordoned and raid was conducted, applicants and other co-accused were apprehended and caught red handed and from their possession respective drugs were seized, this court is not inclined to release the applicants on bail.
