The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.57/2001 registered in Police Station Sariya, Distt. Raigarh (C.G.) for offence punishable under section 34 (2) of Excise Act.

This is a case of bail jump. The applicant was enlarged on bail on 12/11/2008. He attended till 17/03/2010. Subsequently, on 3/05/2010 he remained absent, arrest warrant was issued and on 20/01/2013 permanent arrest warrant was issued in the Lok Adalat. 3.

Learned counsel for the applicant submits that now the applicant has been arrested on 28/09/2016 and the applicant was earlier in jail for 25 days. Taking into such fact, the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the fact that the applicant was earlier enlarged on bail and now the applicant has been arrested on 28/09/2016, taking into the period of detention of the applicant as against the degree of allegation, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the

applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
