The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.143/2016 registered in Police Station Jarhagaon, Mungeli for offence punishable under sections 147, 148, 149, 307, 323, 324, 353 of Indian Penal Code. 2.

As per the prosecution case, on 30/06/2016, the complainant Pankaj Nirnejak who is Constable in the Crime Branch Mungeli alongwith other officers of the Police Station on a secret information received that the applicants and other co-accused aer selling the contraband medicines raided the place in a road wherein they were selling the medicines, at that moment, while the proceedings were being carried out, the complainant Pankaj Nirnejak and Vikas Singh were attacked by the present applicants and other co-accused and one of the co-accused Jamil Shah assaulted Pankaj Nirnejak by way of a knife in his back and the other applicants

assaulted by way of fist & kick.

Learned counsel for the applicants submits that similarly placed coaccused persons have been enlarged on bail by this court on 5/10/2016 vide M.Cr.C. Nos.5977 & 6211 of 2016, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail, however he is not able to dispute the fact that similarly placed co-accused persons have been enlarged on bail by this court on 5/10/2016 vide M.Cr.C. Nos.5977 & 6211 of 2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused persons have been enlarged on bail by this court on 5/10/2016 vide M.Cr.C. Nos.5977 & 6211 of 2016, this court is inclined to release the applicants on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
