The present MCC been preferred seeking for restoration of W.P.S No. 4287/2008 which got dismissed on 30.04.2018 for want of prosecution.

According to the applicant, he had in fact engaged a counsel who meanwhile expired and therefore there was no representation on behalf of the applicant when the matter was called on 30.04.2018 and the SPC issued by this Court was never served upon him. Given the facts and circumstances of the case and finding the reasons assigned by the applicant to be satisfactory, this Court is of the opinion that it is a fit case to allow the application for restoration of W.P.S No. 4287/2008.

Accordingly, the present MCC is allowed and W.P.S No. 4287/2008. is restored to its original number. No order as to costs.

Registry is directed to list the writ petition before the appropriate Bench.
