Hon'ble Shri Justice P. Sam Koshy Order On Board 11.09.2019

1. The challenge in the present writ petition is to the order of transfer dated 09.08.2019 Annexure P-1 whereby the petitioner has been transferred from Ramanujganj to Raipur.

2. The contention of the petitioner is that the petitioner is the District Secretary of the Chhattisgarh Pradesh Lipik Vergiya Shaskiya Karmachari Sangh and therefore, he falls under the protected category. According to the petitioner, as per the transfer policy, in a scheduled area, the minimum tenure of posting should be that of 3 years and the petitioner has not completed 3 years at the present place of posting. The further contention of the petitioner is that he has got just about 2 years of service left for superannuation.

3. Given the aforesaid facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from today and the respondents in turn shall consider the same within a period of 45 days from the date of receipt of the representation.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed
