The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.114/2017 registered in Police Station Newai, District Durg for offence punishable under Sections 420, 467, 468 & 471 of the Indian Penal Code.

The applicant is a Teacher in the Government school. He is also involved in arranging training for the students under the Prime Minister Vikash Kaushal Yojna. One Anup Martin lodged the First Information Report (FIR) against the applicant that he falsely assured him of providing trade affiliation from the Central Skilled Council and Indian Society for Youth Empowerment, New Delhi, under the Prime Minister Vikash Kaushal Yojna and for that he obtained two cheques of Rs.5.00 lacs each, one in the name of

Leelas Foundation and the other was stated to be left blank. After some time the complainant received a message from the Bank that the blank cheque of Rs.5.00 lacs has been deposited in the bank account of the present applicant. Thereafter, the complainant did not receive any trade affiliation nor the students who obtained training in his institution were provided an amount of Rs.10,000/- under the Prime Minister Vikash Kaushal Yojna. 4.

It appears the applicant promised to arrange the trade affiliation certificate by acting as a middle man or liasoner. 5.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case; particularly considering the fact that the offences are triable by the JMFC; further considering the fact that the investigation is complete and the charge sheet has already been filed; and also for the fact that the applicant is in detention since 24-5-2017, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
