The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.433/2016 registered in Police Station Purani Bhilai, District Durg (C.G.) for offence punishable under section 306 of IPC.

As per the prosecution case, one Ashok Kumar committed suicide in the month of August, 2016. It is alleged that the applicant who had given him the loan of Rs.2000/- was demanding Rs.30,000/- by obtaining signature on the stamp paper after intoxication. Thereby, he was pressurized and committed suicide.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that the agreement has also been seized and only bald allegations have been levelled against the applicant and the applicant has not abetted commission of crime, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents as also perused the
cheque and the agreement. Taking into such fact and also considering the facts and circumstances of the case, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
