The present MCC has been filed seeking restoration of WPS No.276 of 2013 which got dismissed on account of peremptory order passed by this court on 18.07.2018.
The order dated 18.07.2018 was for moving appropriate application within 4 weeks for impleading the selected candidates as necessary party. The petitioner submits that subsequently now he is in a position to carry out necessary amendment as is required. Given the aforesaid facts and circumstances of the case and considering the reasons assigned in the application, this court is of the opinion that a strong case is made out for allowing this MCC. Accordingly, the MCC stands allowed. WPS No.276 of 2013 stands restored to its original number subject to petitioner's curing the defaults within a period of 7 days from the date of receipt of certified copy of this order.
