1. The limited relief that the petitioner has sought for is for appropriate direction to the respondent No.5 to consider canceling the order of attachment of the petitioner from Janpad Panchayat, Korba and he be sent to his substantive place of posting i.e. Janpad Panchayat Podi Uproda.

The request made by the petitioner is on the ground that a person against whom he was attached at Janpad Panchayat, Podi Uproda has since been transferred to a different district and the post has fallen vacant and therefore the petitioner can now be sent to his substantive place of posting. The place has not been occupied by any other person.

Given the said limited relief, let petitioner make a fresh representation to the respondent No.5 within a period of 10 days from the date of receipt of copy of this order and respondent No. 5 in turn shall consider the representation of the petitioner within a period of 60 days from the date of receipt of copy of this order. While deciding the same, respondent No. 5 shall also consider the instructions of the State Government whereby they have passed orders for canceling the orders of attachment and sending all the persons who are on attachment to their substantive place of posting. 4.
With the aforesaid observations, the present writ petition stands disposed of.
