Order On Board By Prashant Kumar Mishra, J.

17/10/2019

1. Heard.

2. The Contempt Petition would arise out of the order dated 25.02.2019 passed in WPC No.676 of 2019 which in turn was based on a Division Bench order passed in WPC No.1649 of 2017 (Smt. Anita Agrawal Vs. State of Chhattisgarh and Others). The petitioner's writ petition was disposed of with a direction that he shall move a representation before the concerned Collector (Land

CONT No. 778 of 2019 Acquisition) within a period of 4 weeks. Thereafter the said Collector, shall decide the representation within 10 weeks from the date of State Government's fresh Notification in terms of the direction issued by the Division Bench.

3. Respondent's Counsel would inform that Review Petition No.190 of 2019 filed by the State for review of the order passed in WPC No.1649 of 2017 (Smt. Anita Agrawal Vs. State of Chhattisgarh and Others) has been entertained by the Division Bench and the same is pending consideration

4. In view of the pendency of review application against the main order passed in the matter of Anita Agrawal (supra) it would not be appropriate to continue with this contempt petition.

5. Accordingly, the contempt petition is disposed of. However, in view of the order Annexure R-2, deciding petitioner's representation, it will remain open for the petitioner to file a fresh writ petition and/or contempt petition depending upon the outcome of the Review Application filed before the Division Bench.
