The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.133/2016 registered in Police Station Khadgawan District Koriya (CG) for offence punishable under sections 306, 34 of IPC.

As per the prosecution case, one Shantanu wife of the applicant committed suicide on 16/08/2016 by consuming poison. She was married to the applicant on 23/04/2016. Thereafter, she was abetted and was ill treated by the applicant and the mother-in-law and asked her to go away from the house and was also abused and assaulted, thereby abetted commission of crime. Consequently, she committed suicide. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, allegations are general in nature and the applicant has not abetted the deceaesd to commit suicide, charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of father Pannalal Sahu and mother

Tukumvati. Considering such statement, without further observation on the merits and also for the fact that charge sheet has been filed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
