The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.98/2018 registered in Police Station Purani Basti, Raipur (C.G.) for offence punishable under section 379 of IPC.

As per the prosecution case, one Hem Sagar Bagh lodged a report on 16/05/2018 that his motorcycle bearing No. C.G. 04 LP 5383 was stolen. Subsequently, the motorcycle was recovered from the present applicant.

Learned counsel for the applicant submits that there was no intention as there has been some misunderstanding has been caused whereby there was exchange of motorcycle. He submits that charge sheet has been filed, no further investigation would be necessary therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, charge sheet has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the

applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
