The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.760/2016 registered in Police Station Supela Durg (CG) for offence punishable under sections 171, 420, 468, 471, 34 of IPC.

As per the prosecution case, one Gulab Singh was discharging his duty on 15/08/2016, at that time two persons came to him in the police uniform and told their name as Tikam Sinha and Dhanraj Bhande and stated that they have come to join the duty. On being asked, it was told that they were sent by Shailendra Banjare. Thereafter, Shailendra Banjare also came in police uniform with a batch of Chhattisgarh Jail and on being asked they could not satisfy the said constable, applicant and the other co-accused were arrested.

Learned counsel for the applicant submits that there is no inducement to give appointment letter, therefore no offence under Section 420 of IPC is made out. He further submits that co-accused has been enlarged on bail, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Case diary documents shows that the applicant is the main architect of committing crime, other co-accused have been enlarged on bail considering fake seal were prepared and fake appointment letter were got typed whereas against this applicant at his instance same act was done and from the applicant police uniform and other identity card were seized. Taking into such facts and nature of allegation, this court is not inclined to release the applicant on bail.
