2. By the impugned order, the plaintiff's application for amendment in the plaint has been rejected.

Taking into consideration the submissions of the parties and that the amendment appears to be just and proper for proper disposal of the suit, the amendment is allowed and the plaintiff is permitted to amend the plaint within three weeks from today and the defendants will also be entitled to make consequential amendment in the written statement.

The writ petition is allowed to the extent indicated herein-above. No order as to cost(s).
