The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.356/2016 registered in Police Station Sarkanda District Bilaspur (C.G.) for offence punishable under sections 457, 380, 411, 34 of IPC.

As per the prosecution case, on 30/05/2016 a theft was committed in the shop of Look and Me which was owned by Nitin Tomar and shirt, pant, LED TV and cash of Rs.2000/- total Rs.45,000/- was stolen. Subsequently, police arrested Sibu, Rahul Yadav, Vishal, Ravi and Rahul Suryavanshi and it was revealed that the applicant had received the stolen goods. Thereby, offence has been committed.

Learned counsel for the applicant submits that only allegation against the applicant is that he has received goods and it is submitted that applicant has received the goods for consideration and he has not committed any theft, charge sheet has been filed, no further investigation would be necessary, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Considering the facts and circumstances of the case, charge sheet has been filed and the applicant is in jail since 9/06/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
