This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.431/2014 registered at Police Station- Khamtarai Raipur, District Raipur (C.G.) for the offence punishable under Sections 420, 467, 468, 471, 120-B of Indian Penal Code. The first bail application was dismissed as withdrawn on 27.01.2016 in MCRC No.181 of 2016 with liberty to repeat the same after examination of the material witnesses.

Learned counsel for the applicant would submit that the charge sheet has been filed and the applicant is lodged in jail since 03.10.2015 and the trial is not in progress, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the fact that the first bail application was dismissed with liberty to repeat the same after examination of the material witnesses, I do not find any change of circumstances to reconsider the instant second bail application.

Accordingly, the bail application is dismissed at the admission stage itself. However, this Court deems it proper to observe that the Trial Court may expedite the trial.
