The present petition is for cancellation of bail under Section 439(2) of the Code of Criminal Procedure.

Perusal of the order would show that the bail was granted by the Court of Special Judge S.C. S.T. (PA) Act, Bilaspur and therefore the petition is dismissed with a liberty to the petitioner to approach the Court below, which has granted bail so that the Court below can apprise the facts which were existing for grant of bail. At this stage, it would be too premature to presume any facts by this Court. 3.

Accordingly, the petition is dismissed as withdrawn with liberty to the petitioner to approach the Court below.
