The instant CRMP has been preferred under Section 482 of the Code of Criminal Procedure, 1973 ( in short 'the Code') for restoration of Acquittal Appeal No.164 of 2015. Said Acquittal Appeal vide peremptory order dated 08-10-2015 dismissed for non-compliance as the appellant failed to remove the default as directed by this Court.

The instant CRMP, on due consideration, is hereby allowed subject to the condition that the applicant/appellant shall remove the default in said Acquittal Appeal No.164 of 2015 within two weeks from today. On removal of the default as pointed out, said Acquittal Appeal No.164 of 2015 be restored to its original number.

Copy of this order be annexed with said acquittal appeal. 5.

The CRMP disposed of.
