Versus
1. State Of Chhattisgarh Through The Secretary, Forest Department Mantralaya, Mahanadi Bhawan, New Raipur, District Raipur, Chhattisgarh
2. The Forest Divisional Officer, Kanker Forest Division, District North Bastar Kanker, Chhattisgarh
3. The Deputy Divisional Forest Officer, Kanker, District North Bastar Kanker, Chhattisgarh ---- Respondents For Petitioners :
Shri Goutam Khetrapal, Advocate For State :
Shri Majid Ali, Dy. Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 03/10/2018 The petitioner while working on the post of Ranger stood retired from service on 31.08.2018. Though it is only about one month time that the petitioner has retired, till date his retiral dues have not been released which is the substantive grievance of the petitioner. 2.
Counsel for the petitioner submits that there is only a notice issued by the respondents in respect of some loss suffered by them to the tune of Rs.1,56,000/-. He submits that so far as the retiral dues are concerned, the petitioner is entitled much more than the said amount.
3.
Given the said nature of dispute which the petitioner has raised, this Court is of the opinion that ends of justice would meet if the writ petition itself is disposed of with a direction to respondents 1 & 2 to take a decision of immediately releasing the entire dues payable to the petitioner after retaining the amount of Rs.1,56,000/-, the fate of which also would be after giving an opportunity of hearing to the petitioner. Let the remaining undisputed retiral dues payable to the petitioner be paid within a period of 90 days from the date of presentation of the order passed by this court. Needless to mention that the respondents are expected of taking a decision in accordance with the rules governing the field. Sd/- (P. Sam Koshy) JUDGE Bhola
