(1) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 42/2015 registered at Police Station Lundra, District Surguja (C.G.) for the offence punishable under Sections 147, 148 & 304 read with Section 149 of the Indian Penal Code. (2) Applicant's first bail application was dismissed on merits by this Court vide order dated 28.09.2015 passed in M.Cr.C. No.5097 of 2015.

(3) Having heard learned counsel appearing for the parties, having regard to the facts & circumstances of the case, I do not find any change in circumstances to entertain this second bail application.
