02. Heard on IA No.01/2016, application for withdrawal of the petition.

03. Counsel for the petitioner submits that he may be permitted to withdraw this petition as the petitioner wants to file an application for grant of temporary bail under Section 439 of Cr.P.C. He, however, prays for direction to the Registry for return of certified copy of the impugned order dated 16.9.2016.

04. In view of above submission, IA No.01/2016 is allowed and the petition is, accordingly, dismissed as withdrawn. However, Registry is directed to return certified copy of the impugned order dated 16.9.2016 to counsel for the petitioner on his furnishing authenticated xerox copy of the same.
