This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 190/2016 registered at Police Station Chakarbhata, O.P. Sakri, District Bilaspur (C.G.) for offence punishable under Sections 457, 380 of IPC. 2.

As per the prosecution case, on 9/06/2016 and 14/06/2016 a report was made by M.M. Mishra Principal of the Government Higher Secondary School, Barni that when school was opened it was found that 7 pieces of microscope were stolen from the laboratory. Subsequently, during investigation one Sanjeev Chaturvedi was arrested and on his memorandum he disclosed that the said Sanjeev Chaturvedi alongwith applicant and others have committed the theft. Thereby, offence has been committed.

Learned counsel for the applicant submits that there has been several raid has been conducted in the house of the applicant but

nothing was found, as such the applicant has been falsely implicated in the case, therefore he may be granted benefit of anticipatory bail. 4.

Learned State counsel opposes the prayer for grant of anticipatory bail.

Considering the stage of investigation and the documents collected, I am not inclined to extend benefit of anticipatory bail to the applicant.
