The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.118/2016 registered in Police Station Through Police Station D.D. Nagar Tahsil & District Raipur (CG) for offence punishable under sections 395, 397, 347, 450, 506 of the Indian Penal Code and Sections 25, 27 of Arms Act. 2.

As per the prosecution case, a report was made by one Mahendra Kashyap on 18/08/2016 that the applicant alongwith other co-accused entered into the house of the complainant, thereafter tied the family members. Subsequently, one of the family members of the complainant was taken to the office and Rs.2,52,800/- was looted. 3.

Learned counsel for the applicants submits that the applicants have been falsely implicated in the case, the story as projected is completely improbable, no evidence is available against the applicants as the house could not have been opened in the way as has been projected by the prosecution. He submits that the charge sheet has been filed, therefore

the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim and the family members. Considering the fact and the evidence available against the applicants and also for the fact that the applicants have been identified, this court is not inclined to release the applicants on bail.
