1. The challenge in the present writ petition is to the order Annexure P1 dated 22.08.2019 whereby the services of the petitioner has been transferred from Janjgir-Champa to Jashpur.

2. The contention of the petitioner is that the petitioner was earlier posted at Bemetara at his own request and expense. The petitioner was brought on the present place of posting vide order dated 11.08.2017 and in the process the petitioner has also lost his seniority and barely just about two years time the petitioner a

Class-IV employee again being transferred from the present place of posting to Jashpur. Further ground of challenge is that the father of the petitioner is dependent upon the petitioner and suffering from Paralysis. He needs personal attention of the petitioner. Further ground of challenge is that the petitioner's wife is also in government employment and is posted at a place nearby where the petitioner is posted and according to the policy of the State Government for accommodating husband and wife at the same place as far as possible, the petitioner should not have been disturbed.

3. Given the facts and circumstances of the case, let petitioner approach respondent No.1 within a period of 10 days from today by making detailed representation and respondent No.1 in turn shall decide the same within a period of 45 days. Respondent No.1 is directed to consider the representation of the petitioner sympathetically.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as petitioner is concerned shall remain stayed.

5. With the aforesaid observations, the writ petition stands disposed of.
