This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.216/2018, registered at Police StationSurajpur, District-Surajpur (CG), for the offence punishable under Section 21 (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter called as "NDPS Act") 2.

Case of the prosecution, in brief, is that the present applicant was found in possession of 973 bottles of cough syrup containing 194 grams of codeine, which is punishable under Section 22 (B) of the NDPS Act. 3.

After hearing learned counsel for the parties and considering the quantity of codeine i.e. 194 grams as per notification under the NDPS Act, I do not find any ground to entertain this bail application. Accordingly, the bail application is rejected.
