This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.51/2016 registered at Police Station- Kelhari, District Koriya (C.G.) for the offence punishable under Section 306 of Indian Penal Code. 2.
As per the prosecution case, on 17.04.2016, the deceased Shyama Bai who was married to Ramesh Sahu on 28.05.2010 committed suicide by consuming poison because of the fact that she was being ill-treated in her matrimonial home and thereby she abetted to commit suicide.

Learned counsel for the applicant would submit that the applicant has been falsely implicated as no allegations have been attributed to this applicant, who is mother-in-law and the entire allegation is attributed to the son of the applicant as the deceased was being illtreated by her son. He further submits that the charge sheet has been filed and no further investigation is necessary, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the statement of father of the deceased Hanshraj. Considering such statement and the nature of allegation and further considering the fact that the charge sheet has been filed and the applicant is in jail since 08.08.2016, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for her appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
