1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 05.09.2017 in connection with Crime No. 301/2017 registered at Police Station P.S. Golbazar, District-Raipur (CG) for the offence punishable under Section 420/34.
2. As per the prosecution case, a complaint was made by one Sandeep alleging that in order to providing job in the State Bank of India, the applicant has obtained an amount of Rs.4 Lakhs from him. Thereafter, when the matter was investigated, it was revealed that the applicant has obtained money from other 21 persons total amounting to Rs.55 Lakhs in order to provide job to them in the State Bank of India.
3. Learned counsel for the applicant submits that the complainant has given no objection in favour of the applicant before the Court below, which is also placed on record and the amount was not taken for providing job. He would further submit that there was monetary transaction and the nature of case is civil, therefore, the applicant may be released on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. Perused the statement of Sandeep Kumar Sahu, Rishi Rathore, Neelkamal, Gopal Sahu & Ravi Sharma. Considering the same and the nature of allegation, I am not inclined to release the applicant on bail. Accordingly, the bail application is dismissed.
