Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 12/12/2017

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.165/2017 registered at Police Station Nawagarh, District Janjgir Champa for offence under Sections 294, 186, 353 and 332 of the IPC.

2. The applicant has allegedly deterred the public servant i.e. lineman of the Electricity Department while he was repairing electricity supply line at 1.45 hours on 28.8.2017.

3. Learned State Counsel would oppose the prayer for grant of bail on the ground that the applicant is habitual offender.

4. Criminal antecedents of the applicant would not involve commission of any serious or heinous crime. They all are relating to causing simple hurt, criminal intimidation etc.

5. In the present offence, the applicant is in jail since 4.9.2017 i.e. for more than 3 months; the offences are triable by the Judicial Magistrate 1st Class and the investigation is complete, therefore, this Court is inclined to release him on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
