1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 24 of 2017 registered at Police Station Basna, District Mahasamund for the offence punishable under section 307 of IPC.
2. As per the prosecution case, on 13.12.2017 the applicant abused and assaulted his wife, thereafter set her on fire by pouring kerosene oil on her and thereby tried to commit murder.
3. Learned counsel for the applicant would submit that the applicant has been falsely implicated, the FIR is grossly delayed and no explanation has been assigned. He further submits that the applicant is in jail since 07.01.2017 and the charge sheet has been filed, no further investigation is necessary therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail
application.
5. Perused the case diary as also the statement of victim and the dying declaration. It appears that direct allegations have been made against the applicant.
6. Taking into the nature of allegations, I am not inclined to release the applicant on bail. Accordingly, this bail application is rejected.
